CSPA sues Solano Garbage Company for violations of Stormwater Permit

January 21, 2009 -- CSPA has filed a lawsuit against Solano Garbage Company in Fairfield for massive violations of the state's General Industrial Stormwater Permit over the last six years. 

The 10-acre storage and recycling facility transports and stores waste materials, including scrap metal, tires, construction debris and numerous chemicals.  Runoff from the site discharges to McCoy Creek and Suisun Slough, which flow into Grizzly Bay and Suisun Bay. 

The lawsuit alleges that waste discharges from Solano Garbage exceed allowable standards for iron, zinc, aluminum, electrical conductivity, suspended solids and total organic carbon.  It further alleges the facility has failed to: 1) develop and implement an adequate Stormwater Pollution Prevention Plan, 2) comply with monitoring and reporting requirements and 3) implement standard Best Management Practices to control discharges of pollutants. 

The action asks the court to: 1) declare Solano Garbage to be in violation of the law, 2) enjoin defendant from discharging pollutants, 3) enjoin defendant from further violating the substantive and procedural requirements of the permit, 4) comply with monitoring and reporting requirements, 5) prepare a legally adequate Stormwater Pollution Prevention Plan, 6) pay civil penalties for each day of violation and 7) award CSPA the costs of bringing the complaint.
