Judge Wanger rules in favor of Delta Smelt
October 9, 2009 -- Judge Wanger, Federal District Court, has firmly rejected Pacific Legal Foundation’s challenge to the delta smelt biological opinion, which claimed that the FWS could not regulate delta smelt under the commerce clause of the constitution because it was a purely intrastate species. As the Judge noted, their claims are “not new and have been universally unsuccessful before other courts.” Happily, he followed that trend here.
