CSPA SealCSPA files Notice of Intent to sue the Rio Bravo power facility for discharge of carcinogens into streams leading to Sacramento River

February 12, 2009 -- Attached is a Notice of Intent to sue for violations of California's Safe Drinking Water and Toxic Enforcement Act (otherwise known as Proposition 65) that CSPA issued to Rio Bravo Rocklin, a power generation facility located in Lincoln California. Proposition 65 prohibits the discharge of chemicals known to the state to cause cancer, birth defects or other reproductive harm to sources of drinking water.  CSPA alleges that Rio Bravo Rocklin discharges arsenic, lead, lead compounds, nickel and nickel compounds into natural creeks and watercourses tributary to the Sacramento River. 

The Notice Letter informs the discharger that CSPA intends to bring an enforcement action 60-days after effective service of the notice unless public enforcement agencies begin and diligently prosecute an action against the violations.  CSPA has an existing enforcement action against Rio Bravo Rocklin for major violations of California's General Industrial Stormwater Permit.  That lawsuit was filed 4 June 2008.
