Response from Mr. Lauffer, via E-mail, January 27, 2009

Mr. Jennings,

I am always willing to meet to discuss issues presented to the board. In scanning over your letter, though, there are a number of issues raised in pending petitions before the board. In fact, some have already been resolved in CSPA’s favor by recent precedential orders of the board. Some have been resolved in recent precedential orders contrary to CSPA’s position. Still others are being addressed in draft orders out for public comment or out shortly for public comment. And still others (namely, chronic toxicity and antidegradation) are part of on-going State Water Board planning activities.

I will have to consider the appropriate manner in which discussion of some of those issues could occur. I will follow up within the next couple weeks and attempt to coordinate a meeting and include, to the extent necessary, USEPA, the Central Valley Water Board, and others.

Regards, -maml
