Gladding McBean agrees to $135,000 settlement in pollution case

September 9, 2008 -- On February 8, 2007 CSPA filed a Complaint in the United States District Court for the Eastern District of California against Gladding McBean, a large clay products manufacturing facility in Lincoln, CA. CSPA's complaint alleged that the company was responsible for a large amount of pollutants (metals, low pH, sediment, etc.) discharged into tributaries of the Sacramento River.

While not admitting guilt, the company agreed to a settlement on August 28, 2008, that included $70,000 to the Rose Foundation for Communities and the Environment for the sole purpose of providing grants to environmentally beneficial projects within the lower Sacramento River watershed and the Sacramento-San Joaquin River Delta relating to water quality improvements in those areas.

The company further agreed to maintain in good working order all storm water collection and treatment systems currently installed or to be installed and to improve the storm water pollution prevention measures at the drop inlets and outfalls at the facility. In addition, Gladding McBean agreed to pay  up to $17,000+ for compliance monitoring for the maintenance and improvement of its facilities.
